N26m scam: Fani-Kayode seeks out-of-court settlement

Former Aviation Minister, Femi Fani-Kayode, on Monday, asked the Federal High Court Abuja, to adjourn his case to allow him explore other options of settlement aside from going to trial.

Counsel for Fani-Kayode, Mr Ameh Raji (SAN), who made the application on his behalf said that since the sum of money involved was only N26 million, he believed that there were other options of settlement.

Raji added that moreover, he was new on the case and would need some time to go over the facts of the case to enable him defend his client effectively.

“My Lord, I am just coming into the case, so I crave your indulgence to enable me familiarize myself with the case.

“Secondly, looking at the facts of the case and the money involved, I believe that there are other options we can explore.

“The case involves the sum of N26 million and the law allows you to explore the option of a plea bargain and so many other options rather than go through trial,” Raji said.

He said that if the Economic and Financial Crimes Commission was amenable to plea bargain, the defence would take the option. The prosecuting counsel, Mr Johnson Ojogbane said he was not opposing the application.

Ojogbane, however, asked the court to take cognizance of the fact that this was the second adjournment at the instance of the defence and asked for a definite date to commence trial. The judge, Justice John Tsoho, adjourned the matter till March 14 for commencement of trial.

Fani-Kayode was arraigned by the Economic and Financial Crimes Commission before Justice Tsoho on a fresh five counts bordering on money laundering.

The ex-aviation minister was accused of allegedly collecting N26 million from the Office of the Former National Security Adviser, Sambo Dasuki and using same for media campaign.

Count two of the charge read that;” You Femi Fani-Kayode, converted N26 million cash paid from the office of the National Security Adviser for the purpose of media campaign when you ought to have reasonably known that the said funds formed part of an unlawful act contrary to section 15 (2) (b) of the Money Laundering Act.”

Following the argument of his bail application by the counsel who represented him on that day, Mr Ifedayo Adedipe (SAN), he was admitted to bail in the sum of N50 million and one surety in like sum.

Fani-Kayode is facing another 17 counts of money laundering before the Lagos division of the court.

Despite having been served court notices for the enforcement of his fundamental human rights, the Economic and Financial Crimes Commission, EFCC, Monday took Chief Femi Fani-Kayode into an Ikeja magistrate court where they obtained a warrant to keep him in their custody for another three weeks.

Fani-Kayode’s lawyers had served the EFCC the court notices from a Federal High Court in Abuja on Friday, 20th of May, 2016, but he was whisked to Lagos last Thursday and taken to an Ikeja Magistrate today where EFCC applied to keep him for another thirty days.

Reacting, Jude Ndukwe, Fani-Kayode”s media aide said his principal was “sneaked” to the court to obtain the “highly contentious judgement.”

A statement he signed said, “This is a gross abuse of court processes and a denial of his fundamental human rights. It is even most shocking that EFCC attempted to take him to the magistrate court without notifying his lawyers or family members.

“His lawyers had to go from court to court in Lagos searching for venue of the court proceedings before they eventually traced it to Ikeja. This type of treatment to any citizen of our nation especially in a democratic era is, to say the least, inhuman.

“One wonders why a case already before a High Court was entertained in a magistrate court, and judgement given immediately. This smacks of nothing but vendetta. EFCC have no reasonable cause to continue to keep Chief Femi Fani-Kayode in their custody beyond the constitutional provision of 48 hours.

“He is not known to have either attempted to evade arrest nor resisted same. EFCC have since concluded their investigations by the virtue of details of the case they leaked out to the public through the press.

“So, they have no reason to keep having him in their custody without taking the noble option of charging him to court, after all, they have already kept him with them long enough. As an organisation that prides itself as a constitutionally responsible one, it is expected that holding a citizen endlessly would not be part of EFCC’s operations.

“If they have anything against Chief Fani-Kayode, one expects that they should charge him to court rather than obtaining contentious remand warrants from one court to the other. The EFCC had earlier obtained a similar remand warrant in Abuja to keep him for two weeks which has since elapsed.

“This latest action by EFCC has confirmed rumours making the rounds that the federal government wants to give the former Minister of Aviation the Dasuki/Naamdi Kanu treatment, a treatment alien to our laws but is fast becoming the norm under the current administration.”

EFCC traces N3bn transfers to Fani-Kayode, Falae, others



The Economic and Financial Crimes Commission has traced N3.145bn transferred to the private accounts of some members of the Peoples Democratic Party Presidential Campaign Organisation.
According to detectives at the EFCC, the money emanated from the account of the Central Bank of Nigeria and was transferred to the account of a company, Joint Dimensions Limited, and then sent to various accounts.

Authorities of the anti-graft commission said out of the money, the Director of Publicity of the organisation, Chief Femi Fani-Kayode, received N840m. According to the documents sighted by Punch correspondent, the money was deposited into Fani-Kayode’s Zenith bank account, Maitama Branch with number 1004735721 on February 19, 2015.

The detectives said a former Secretary to the Government of the Federation and National Chairman of the Social Democratic Party, Chief Olu Falae, received N100m through a company, Marreco Limited, where he is chairman. The fund was credited into the company’s United Bank for Africa Plc account number 1000627022 on March 25, 2014.

According to the documents, N320m was also paid into the bank account of the Goodluck Support Group, an association which played a major role in Jonathan’s campaign.

A former Governor of Imo State, Achike Udenwa, and a former Minister of State for Foreign Affairs, Viola Onwuliri, according to the documents, got N350m in two tranches. The first tranche of N150m was paid into their joint account with Zenith bank on January 13, 2015. The second tranche of N200m was credited into their account with Diamond bank.

A source at the anti-graft agency who pleaded not to be named because he is not authorised to speak said, “The money was paid by the Central Bank of Nigeria into the account of the Ministry of External Affairs Library, from where it was moved into the account of Joint Trust Dimension Nigeria Limited.

“It was from the Joint Dimension’s account with Zenith bank that the money was shared to various individuals and organisations for purposes that are not stated.

“Fani-Kayode was the chief beneficiary of the disbursement as he allegedly received a whooping N840m, paid in three tranches into his Zenith bank, Maitama branch account with number 1004735721.

“The first tranche of payment involving N350m hit the account on February 19, 2015. Another N250m was also paid into the account on February19, 2015 while N240m was similarly credited to the account a month later; precisely, March 19, 2015.

“The balance in this account as of December 31, 2015 was N189, 402.72.”

The detectives added that the Director of Finance of the campaign organisation, Nenadi Usman, also got N36.9m through her Zenith bank account with number 1000158311 on 7, Kachia Road, Kaduna.

Presidential Campaign Coordinator of President Goodluck Jonathan in Anambra State, Chief Okey Ezenwa, who is also the brother-in-law to a former Rivers State Governor, Chief Peter Odili, also got N100m, according to the source.

He added, “But as things stand, the fact that most of the payments were made in the weeks preceding the last presidential elections leaves very little to the imagination. Yet, one knotty question that confronts the investigators is the unknown figure behind Joint Trust Dimension Nigeria Limited and the account where the money was warehoused before being wired to sundry beneficiaries. The shadowy figure could help unravel the mystery shrouding the payments, once the veil is lifted.”

However, Fani-Kayode told Punch correspondent on the telephone that he never received money from the CBN.

Rather, he said the monies that were spent were received from Usman who was the director of finance of the campaign organisation. The former Minister of Aviation said he never spent government funds but was told by Usman that the monies were sourced from private donations.

He said, “I served as the director of publicity and I was told to set up an account for the directorate, which I did. I never received money from the CBN but like all the other directors, we received money from the director of finance.

“I was assured that the monies were not public funds but were sourced from private individuals. I never knowingly spent government money all through. The monies were spent specifically on the campaigns. The accounts were audited and we were commended by the President.”

All attempts to get Usman proved abortive as her phone indicated that it was switched off. Similarly, the phone number of Falae indicated that it was switched off when Punch correspondent attempted to reach him for comment.

However, the former SGF had said he received money to campaign for Jonathan through a former Chairman of the PDP Board of Trustees, Chief Tony Anenih. When contacted on the telephone, Udenwa told Punch correspondent that he never received any money as he did not even operate a Zenith bank account.

“I don’t operate a Zenith bank account, so, I don’t know what you are talking about,” he said.

Yesterday’s assertion by the National Chairman of the Peoples Democratic Party, PDP, Senator Ali Modu Sheriff that former Aviation Minister, Femi Fani-Kayode will not go scot free for linking him with the Boko Haram sect, has been described by the latter as an empty threat.

Sheriff, at his formal take over as National Chairman on Monday, said Fani-Kayode would not go scot-free for alleging that he nurtured the terrorist group into the monster it has presently become.

But addressing journalists shortly after the opening session of PDP Former Ministers’ Forum on Tuesday, the former Minister said it was unfortunate that Sheriff, who came in as National Chairman to move the party forward, was issuing threats to members.

“This, I think is unacceptable and nobody is intimidated. The fact of the matter is that he wants to set Nigeria on fire, he also wants to set PDP on fire and that fire is going to consume him and him alone,” he stated.

Fani-Kayode maintained he is more than ready to meet Sheriff in court, threatening that, “I am not like anybody he has met before in his life. He will meet a resistance he never expected.”

Former Minister of Aviation and a chieftain of the Peoples Democratic Party, Olufemi Fani-Kayode, has launched another attack on President Muhammadu Buhari, the Minister of Defence, Rtd Brig. Gen. Mansur Mohammed Dan Ali and the Chief of Army Staff, Lt Gen Tukur Yusuf Buratai over the alleged ‘secret burial’ of soldiers reportedly killed by Boko Haram insurgents.

The media was recently awash with news of the alleged abduction and killing of 105 soldiers in northeastern part of the country. However, the military authority had since debunked the story, saying that none of its men was missing.

Reacting to the development via his Twitter handle on Wednesday, Fani who is known for his controversial tweets challenged the government to speak up on the whereabouts of the soldiers if they were still alive.

He tweeted, “This is wickedness of the highest order and Pres. Buhari, his Chief of Army Staff and his Min. of Defence should bury their heads in shame.

“I am outraged by the fact that a soldier will sacrifice his life for his country yet the citizens of that country don’t even appreciate it.

“Anyone that buys the lie and propaganda that the 105 soldiers never died and that they are still alive is a compound fool or village idiot.

“Will the military also deny the fact that 2 days ago 34 of our soldiers were killed by BH. These boys died for their country. Why deny them?

“All we want from the military is the truth. If 105 were not killed then how many were killed?”
